Terms & Conditions

These terms and conditions apply directly to the booking of training courses with MaxCap Consultants Ltd, where by booking onto a course you are agreeing to accept the following terms and conditions:

Payment

  • Payment for bookings receiving an ‘Early Bird’ discount must be received, in full, more than 30 days prior to the course start date.
  • Any bookings made within the 30-day window will require immediate payment, in full, to secure the delegate’s space and will not receive the ‘Early Bird’ discount rate.
  • All payments must be made in pounds sterling.
  • Payment can be made immediately online using a Debit/Credit Card via PayPal or by bank transfer, our bank account details can be found on your invoice if you booked directly with us (please quote your invoice number as a reference).
  • All fees are subject to VAT at the prevailing rate.
  • MaxCap Consultants Ltd reserves the right to remove delegates from a course and refuse attendance to a course where payment has not been received within the agreed time period. Their space will be released and may be sold to another delegate.
  •  “In-house training” courses only: Our fees will be quoted separately on a course by course basis and will include trainer travelling expenses, subsistence and overnight accommodation if required.
  • Where a client specific course has been requested, and includes a request for course content customisation, then the fees for this work will be agreed and clearly specified in a separate Statement of Works (SOW) document.
  • If a client cancels where client specific content development work has taken place this work will be charged for in full as per the SOW.

Cancellations, transfers and substitutions

  • All cancellations must be notified directly to MaxCap Consultants Ltd via email, using email address of bookings@maxcapconsultants.com
  • All bookings can be cancelled or transferred, however fees will apply as follows:
    • Up to 20 working days prior to the course start date.
      • Changes can be made free of charge.
    • Between 20 and 10 working days prior to the course start date.
      • 50% of invoice value will be applied as a cancellation or transfer fee.
    • Less than 10 working days prior to the course start date.
      • 100% of invoice value applies, no refunds/credits will be provided.
  • If you have claimed ‘Early Bird’ or ‘Block Booking’ discounts when booking your spaces, then the following cancellation and transfer rules apply:
    • More than 20 working days prior to the course start date.
      • Transfers can be made free of charge to later courses.
      • Cancellations will result in a 20% charge against the cost of the specific course places being cancelled i.e. if a course space was charged at £400 a fee of £80 will be charged. The discount will remain in place for the remaining course spaces that were booked if this was a block booking.
    • Less than 20 working days prior to the course start date.
      • 100% of invoice value applies, no refunds/credits will be provided.
  • Working days are defined as Monday to Friday, 9am-5pm, excluding bank holidays.
  • Once a delegate is transferred once, any future cancellations will not be refunded or credited, although a further transfer may be agreed at the discretion of MaxCap Consultants Ltd.
  • Substituting one person for another on a course is allowable free of charge, however we request you notify us via email as early as possible in order that we can make the necessary arrangements.
  • No claim of any sort can be made for a delegate’s inability to attend a course, should the course otherwise run as intended.
  • MaxCap Consultants Ltd reserves the right to cancel a course at any time and offer an alternative date, a credit or a full refund without any liability for consequential or indirect loss.

Residential bookings on public training courses

  • MaxCap does not offer hotel accommodation as part of its services, although discounts from the hosting hotels are offered directly to any delegate that is attending our courses.
  • All residential bookings including accommodation, dinner, bar bills, Wi-Fi, phone bills etc. remain the sole liability of the delegate to settle all charges directly with the hosting hotel before departure.

Catering included on public training courses

  • A light breakfast snack, lunch and mid-day snacks will be provided as well as unlimited tea, coffee and water with every course and costs are included in the course fee.

Intellectual Property

  • Any and all of the materials supplied before, during or after MaxCap’s training courses is the intellectual property of, and solely owned by MaxCap Consultants Ltd and protected by strict Copyright legislation. Unauthorised distribution or reproduction is absolutely forbidden.
  • Courses are not to be recorded in any way, no video or audio recording is allowed, without the prior written consent of MaxCap.
  • All information provided by MaxCap is given in good faith to support the practical implementation of the techniques taught to the attending delegate within the organisation that sponsored the delegate.
  • It is strictly prohibited to utilise or pass MaxCap information on to any other organisation outside of the sponsoring company. If the company in question is a multi-site organisation, then the material is only approved to be utilised by the attending site, further delegates from other sites would need to attend training in order to gain access to the material.
  • MaxCap will not be held responsible in any way, for actions taken by the delegate, or any other individual within the organisation or any other organisation as a result of the information provided during the training course.
  • Training programmes are correct at the time of advertisement. However, some alterations may occasionally be necessary due to circumstances beyond our control. MaxCap reserves the right to alter published course contents, trainers, or venues without prior notice.

Behaviour

  • MaxCap expects all delegates to behave in a respectful and appropriate manner at all times whilst attending our training courses.
  • MaxCap (or its representatives) reserves the right to exclude any attendees from the training course if they behave in a disruptive, abusive or threatening manner. In such an event, no refund will be payable to the excluded delegates or their organisations.
  • Delegates will be held fully liable for the cost of any repairs that are required to be carried out, as a result of any damage caused to any part of our training venue provider’s property, by the negligence or wilful act of that individual.

Health and Safety

  • MaxCap (or its representatives) and all course attendees shall fully comply with all applicable health and safety legislation and codes of practice during training.

Force Majeure

  • MaxCap Consultants Ltd (or its representatives) will not be liable for any failure or delay or for the consequences of any failure or delay in providing training, if it is due to any force majeure event including acts of God, war, industrial disputes, protests, civil disturbance, accidents, epidemics, fire, flood, storm, tempest, explosion, acts of terrorism, national emergencies or any other cause beyond its reasonable control.
